The Common Belief: A Septic Tank Just Sits There and Works
The thing people repeat is that a septic tank is basically self-contained. You don't think about it, you don't maintain it, it handles itself. Some people go years without emptying it because "it's never caused a problem." Others don't realise their system might be discharging illegally. A few have never even located the tank on their property.
That picture was roughly acceptable, legally speaking, until January 2020. It isn't now.

What the 2020 Rules Actually Changed
The Environment Agency's General Binding Rules for small sewage discharges came into force in January 2020 and replaced the old exemption registration system. They're not advisory. They're binding, which is the point of the name.
Here's what the rules actually require, in plain terms:
Where your treated effluent goes matters enormously. A septic tank does not treat sewage to a safe standard for discharge into a watercourse (a ditch, stream, drain that flows to a river). If your system discharges directly to a watercourse, it was already illegal before 2020, but from January 2020 there is no grandfathering, no transition period. You must upgrade.
A drainage field (soakaway) is the legal route for septic tank effluent. The effluent from a correctly functioning septic tank should discharge into a drainage field in soil, not into open water.
Sewage treatment plants have more flexibility. A properly certified sewage treatment plant (sometimes called a package treatment plant or biodigester) can discharge to a watercourse if it meets BS EN 12566-3 performance standards and the discharge consent conditions are met. A septic tank cannot, full stop.
Selling a property changes your obligations. If you're selling a property with a system that discharges to a watercourse, you're responsible for upgrading it before or at point of sale, or agreeing a legal covenant with the buyer that they'll do it. Solicitors are increasingly asking the right questions. The days of burying this in the small print are mostly over.
The Environment Agency can issue enforcement notices, require remediation at the owner's cost, and pursue prosecution for deliberate or repeat non-compliance. In practice, enforcement near Hanham tends to be triggered by a visible pollution event, a complaint from a neighbour, or a routine inspection following a property sale rather than random spot checks. But "we've never been caught" is not a compliance strategy.

The Myth: If the Tank Isn't Overflowing, It's Fine
A blocked or overflowing septic tank is obvious. The smell reaches the house, the ground around the tank is waterlogged, there's sewage backing up. Nobody misses that.

The tank fills to the outlet level, effluent can't drain away, and the system either backs up into the property or finds an alternative exit, typically the nearest low point, which is often a ditch or drainage channel.
Signs that a soakaway is failing:
- Wet or boggy ground over the drainage field, even in dry weather
- Grass growing noticeably greener and faster directly above the field
- Persistent damp smell from the ground in that area
- Slow drainage from all fixtures in the property simultaneously
- Tank needs emptying more frequently than before, despite no change in occupancy
None of these require a camera to spot. They do require someone to go and look at the right part of the garden with the right question in mind.
Outlet pipe failure is the second common finding on surveys. The outlet from the tank, which carries partially settled effluent to the drainage field, can crack, collapse, or become blocked with accumulated solids if the tank is overfull or has gone too long without emptying. I've seen outlet pipes that were completely blocked, meaning the tank was operating as a sealed vessel with nowhere for liquid to go. The pressure builds until something gives, usually a joint.
Inlet pipe offset is less dramatic but common in older installations. Settlement of the ground moves the inlet pipe slightly, creating a lip or drop that means incoming solids hit the water surface instead of entering below it. That increases turbulence, drives more solids through to the outlet chamber, and accelerates soakaway clogging. It's the sort of thing that takes five minutes to confirm with a camera and then informs a sensible maintenance plan.

Emptying: How Often, and What People Get Wrong
The standard guidance is to empty a residential septic tank every 12 months. That's not a law, it's a recommendation, and like most recommendations it's based on an average case.
The actual frequency depends on:

In practice, annual emptying by a registered waste carrier is the safe default for a three or four bedroom property with a normal household.
What people get wrong most often:
- Waiting until there's a problem rather than scheduling preventatively
- Using antibacterial products heavily, then wondering why breakdown is poor
- Flushing wet wipes. The number of times I see compacted non-woven fabric balled up around baffle walls on a survey is not small. Wet wipes do not degrade in a septic tank. They don't degrade in a sewer either, but that's someone else's problem. In your own tank, it's yours.

Always ask for a receipt or consignment note from your emptying contractor. Sewage sludge is controlled waste. A legal operator provides paperwork. If they don't, you have no evidence of compliance and potentially a problem if the Environment Agency comes asking.

Soakaway Failure: What Can Actually Be Done
I want to be direct about this because there's a lot of wishful thinking online about rejuvenating failed soakaways with enzyme treatments or by resting the field.
Resting a soakaway (diverting flow while leaving it unused for a period) can sometimes help a moderately clogged field by allowing the biomat to partially break down. It's worth trying before committing to a replacement, but it requires you to have somewhere to divert the flow in the meantime, and it doesn't work for a field that's severely or structurally failed.
Enzyme treatments and bacterial additives: the evidence is mixed at best. They don't hurt, they won't fix a collapsed pipe or a field in impermeable clay.
For a genuinely failed soakaway, the realistic options are:
Replace the drainage field. New perforated pipe in fresh ground, correctly sized and positioned per BS 6297 or the more recent guidance. Requires a percolation test on the new area first. This is the clean, permanent solution where ground conditions allow.
Upgrade to a sewage treatment plant. If you replace the septic tank with a certified treatment plant, the treated effluent standard is higher, and you can legally discharge to a watercourse (with appropriate consent). This is often the route taken when there isn't sufficient garden area for a compliant replacement drainage field.
Connect to mains sewer. For properties close enough to the network, this is sometimes worth investigating. Wessex Water's Assisted Connection Scheme exists for properties where mains connection is technically feasible. It's not always cheap, but it ends the ongoing maintenance obligation entirely.

What I Actually Find on CCTV Surveys of These Systems
Septic tank surveys are a bit different to standard drain surveys. You're often dealing with brick-built chambers that are decades old, heavy cast iron covers that haven't moved since the 1970s, and pipework that wasn't exactly installed to a precision specification.
Common findings at Hanham-area properties:
Cracked or spalled brickwork in older single-chamber tanks, particularly at the waterline where freeze-thaw cycles do their work over years. Minor cracking is usually stable and can be relined. Significant structural cracking means the chamber is compromised.
Missing or deteriorated baffles. The inlet and outlet baffles are what separate the three zones of a working tank (scum layer, clear zone, sludge layer) and prevent solids from passing straight through to the drainage field. Plastic T-baffles degrade in UV light if the lid is left off; concrete baffles crack and fall away. A missing outlet baffle is a direct cause of accelerated soakaway failure.
Root ingress into distribution pipes. The drainage field distribution pipes are exactly what tree roots are looking for: warm, damp, nutrient-rich. I find this regularly at properties with mature trees within ten metres of the field. Root cutting can clear it, but the underlying pipe is usually compromised and ideally needs replacing.
Incorrect pipe falls. The outlet from the tank and the distribution pipes in the field need to run at the right gradient. Too steep and liquid runs past the distribution holes without soaking in; too flat and solids settle and block. Old systems installed by eye rather than level sometimes have both problems in different sections.
Proximity violations. Current guidance requires drainage fields to be at least 10 metres from any watercourse, 50 metres from a borehole or spring used for drinking water, and not under driveways or areas with vehicles. Some installations I survey predate these rules and don't comply. That's a problem at point of sale even if it's never caused a visible issue.

What to Do if You're Buying a Property Near Hanham with Off-Mains Drainage
Get a CCTV survey of the tank and drainage field before exchange, not after. Your conveyancer will ask for a Property Information Form (TA6) disclosure, but the seller's knowledge of a system they've never maintained is not reliable information.

If the survey finds problems, you have something concrete to negotiate with. If it finds nothing, you have documented baseline condition and peace of mind. Either way it's worth doing.
